Thanks Lisa. I think your billboard relation is spot on. If lawmakers saw it that way, they'd probably think such legislature is absurd. Regardless, it is hard for them to ignore whatever they calculate as potential revenue gained from such a tax. They are going to need to hear from a lot of us if we hope to sway them...

This is a great summary, Brian. This past week a couple more states have introduced similar bills. So it is important that everyone in all states (except maybe the four that don't have sales tax) get active and write letters in opposition of the legislation.

I agree the term affiliate is misleading. I encourage everyone: this terminology was applied to an advertising model to help people better understand the pay-for-performance model. The businesses and individuals are no more local sales agents than a billboard along a state freeway.

One last comment: in preparing for the passing of these laws an affiliate that is located in one of the states with the propsed bills should review which of their merchants are NOT in that state. If the merchant is not and decided to avoid nexus they may drop affiliates from that state. This is what happened with NY. The risk is especially high if the merchant does significant overall business in a given state and only receives limited affiliate traffic.

Please, everyone that reads this, take the time to write a letter or sign a gruop letter or call or visit. Get involved now. We all need to come together on this one.
